- Damages resulting from interruption or cessation of services
- Damages from bugs, viruses, or other harmful components
- Damages resulting from third-party conduct or content
- Damages from errors, mistakes, or inaccuracies in content
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US IN THE SIX MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED EUROS (€100), WHICHEVER IS GREATER.
3. Exclusion of Consequential Damages
We shall not be liable for any loss of business opportunities, loss of profits, business interruption, loss of data, or any other commercial damages or losses arising from or related to your use of our services, whether based on warranty, contract, tort, or any other legal theory.
4. Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
5. Jurisdictional Limitations
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. In such jurisdictions, our liability and warranties will be limited to the greatest extent permitted by applicable law.
Indemnification
You agree to indemnify, defend, and hold harmless Startgate, its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, costs, claims, and demands, including reasonable legal fees, resulting from:
- Your violation of these Terms and Conditions or any applicable law or regulation
- Your violation of any rights of third parties, including intellectual property rights
- Any content you submit, post, or transmit through our services
- Your use or misuse of our services
- Your breach of any representations or warranties made herein
- Any claims made by third parties due to your actions or conduct
This indemnification obligation shall survive termination of these Terms and Conditions and your use of our services.

These Terms and Conditions shall be governed by and construed in accordance with the substantive laws of the Federal Republic of Germany, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.
